About ITAT orders
What is the Income Tax Appellate Tribunal?
The Income Tax Appellate Tribunal (ITAT) is the second appellate authority in income-tax matters. It hears appeals against orders of the Commissioner of Income Tax (Appeals) and certain other orders, and it is the final authority on questions of fact. An appeal from the ITAT lies to the High Court only on a substantial question of law.
What is the time limit to file an appeal before the ITAT?
Under section 253 of the Income-tax Act, 1961, an appeal is filed within 60 days of the date on which the order appealed against is communicated. The Tribunal may admit a late appeal if there was sufficient cause for the delay. For proceedings under the Income-tax Act, 2025, check the corresponding provision.
What does “allowed for statistical purposes” mean in an ITAT order?
It means the Tribunal has sent the matter back to the lower authority to decide afresh. The appeal is counted as allowed for record purposes, but the final outcome depends on the fresh decision.
How can I see orders of one ITAT bench?
Each bench, such as Delhi, Mumbai or Chennai, has its own page listing its orders, newest first. Choose a bench from the list on the ITAT Orders page or the Benches page.
